Set out below are the standard terms and conditions of Hatton Garden Metals Limited ('HGML') which apply in respect of the gold, silver, platinum and palladium purchasing services (the 'Services') offered via HGML’s website, www.hattongardenmetals.com (the 'Website').  References to 'Hatton Garden Metals', 'we', 'us' and 'our' are to HGML.

We are a private limited company registered in England and Wales with number 06426684 whose registered office is at 11 St. Cross Street, Hatton Garden, London EC1N 8UB.  Our VAT number is 926 1883 05.

2.1 When you place an order with us, you are making an offer to buy goods, a contract is only formed once if your order is accepted by us, the seller. Please note, taking payment does not indicate acceptance. If ultimately your order is rejected for any reason, a refund will be made in full immediately.

2.2 Once your order has been accepted you will receive a dispatch notification email.

2.3 In the unlikely event that the goods are no longer available, or that we have made a mis-pricing mistake, we will advise you of this. We reserve the right to cancel your order in these circumstances and terminate your contract with us. Please note: We are under no obligation to provide our product to you at the in-correct price, even if you have received payment confirmation for your order, if the pricing error is apparent and could have been recognised easily as a mis-pricing. Should we need to terminating your contact and cancel your order, we will assess to see whether any default or problem can be resolved by contacting you to try and remedy the breach, in the case of in-correct pricing, this would be to give you the opportunity to buy the item at the correct price. However, when we consider that in our opinion the breech of contact cannot be remedied or it is a result of uncontrollable factors outside our control, information provided to our site by 3rd party suppliers which are inaccurate with regards to precious metals spot pricing we reserve the right to terminate the contract, transaction or service. Termination of our contract will be provided as a written notice.

2.4 Images of products on this website are for illustrative purposes only.

2.5 Whilst we try to be as accurate as possible, all information provided is approximate and is provided in good faith.

2.6 We are entitled to refuse any order made by you for any reason

2.7 Price Match Promise is only available on certain products and is at the discretion of Hatton Garden Metals Ltd. We reserve the right to withdraw this at any time. To benefit from our Price Promise you must contact us before placing your order, and we will only consider Price Matching if the following conditions are met:
- we will price match only against a VAT registered UK retailer where the price of the items in comparison is in GBP. Price match excludes all retailers who are Auction sites/ Market places
- the cost to deliver the item will be considered as part of our price match promise, and our promise excludes vouchers, discount codes, and other promotional material which may have reduced the price item we are being compared to.
- the product must be identical in condition, date and specification and must be an in-stock item.

2.8 This contract is covered by English law.

2.9 By placing an order with us, you agree to and accept these terms, as well as our privacy policy and the terms of website use

3.1 You can use our website to place an order by selecting the product you wish to buy and adding it to your basket. Items you do not require can be removed from your basket at any time.

3.2 Carriage charges will be shown prior to you placing your order.

3.3 You will be required to pay for the goods in full at the time of ordering.

3.4 We use secure payment facilities for online purchases.

3.5 Promotional prices only apply during the period stated.

3.6 All prices quoted on our website are in UK pounds.

3.7 Once your order has been confirmed, changes may not be possible or may incur additional charges or delays.

3.8 Once your order has been dispatched we will send you an email confirming same.

4.1 Goods will normally be dispatched from our stock within 24 hours and any estimated dispatch date is an estimate, which can change without notice.

4.2 We reserve the right to hold an order for any further KYC/AML/ other fraud check that we deem appropriate which may result in a delay to the ‘agreed’ time for the delivery of your goods.

4.3. We will normally deliver goods within 2-3 working days of dispatch, unless a premium service has been purchased.

4.4 Your order may arrive in more than one delivery.

4.5 We can deliver our products anywhere in mainland Great Britain and Northern Ireland. Unfortunately, we do not deliver to the Channel Islands.

4.6 We will deliver the goods to the premises you specify on your order. When placing an order on card, your delivery address must match your credit/debit card’s billing address.

4.7 It is your responsibility to ensure that you can securely receive the goods and that they cannot be intercepted by others at that address. You must be able to personally accept delivery of your order.

4.8 We are unable to accept any liability for packages that have been delivered to houses of multiple occupancy, work addresses, PO boxes, mail boxes or where a postal redirection is in place once signed for or confirmed by our couriers as delivered to that address. We will not accept responsibility for loss or damage or if you instruct the delivery company to leave the goods unattended or in a safe space.

4.9 Please check the goods on delivery - any goods found to be missing, incorrect or damaged should be notified to us immediately on receipt and within seven days of our dispatch to you. We will not entertain any complaint regarding missing or damaged items beyond that timeframe.

5. Sometimes, for reasons beyond our control we may be prevented from delivering your goods as planned. These might include things such as accidents, breakdowns, fire, flood, storm, severe weather, acts of god, war, riot, civil commotion, malicious damage or the default of our suppliers. We will try to put things right as soon as possible however we can't be responsible where this causes a delay or failure in delivering your goods.

5.1 Royal Mail may still choose to delivery your parcel in a Covid-secure way which may mean that the parcel will be placed at your door, and the postman will take your name, rather than an electronic signature. This will constitute a successful delivery and ownership of your goods passes to you and we will not be held liable after this point.

5.1 This policy does not apply to goods ordered by businesses which are exempt from the Distance Selling Regulations.

5.2 We do not accept returned items for a refund unless the goods are incorrectly described or the wrong items are supplied.

5.3 This cancellation policy does not affect your legal rights.

6.1 If there is a problem with the goods, please notify us by email or in writing providing details of the problem. It's helpful if you can provide us with a digital photograph of the problem as this normally saves you having to return the goods for inspection. We will deal with the matter in accordance with your legal rights.

6.2 If an exchange is necessary, this will be arranged without unreasonable delay and without charge. Replacement goods will not be dispatched until the original goods have been received and checked by us.

The cost of returning goods to us is your responsibility; however on inspection we will refund your reasonable postage costs, providing that the goods are found to be faulty. If the goods are not faulty, we will return them to you, however you will be required to cover our reasonable postage costs.

6.3 Within this time scale we will replace defective goods free of charge, at our discretion, providing that you have returned to us any faulty goods upon request.

6.4 All items sent from HGM are checked, sealed and recorded on CCTV before we send out to customers.  We use Royal Mail Special Delivery for safe delivery of our items.  Please ensure that any item that has been tampered with or appears damaged is not signed for and rejected.  Once an item has been signed for we are longer responsible for the articles contained within.  Upon accepting our terms and conditions you are agreeing to this policy.
